Terms of Service

Effective date: September 1, 2026

Please read these Terms of Service ("Terms") carefully before using the TypeUI website, dashboard, design skill registry, prompt catalog, downloadable design skill markdown files, UI prompt resources, and related hosted resources (collectively, the "Service") operated by Bergside LLC ("Bergside," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using the Service, creating an account, downloading resources, purchasing a TypeUI subscription, or redeeming a partner code, you agree to these Terms and to our EULA. If you do not agree, you may not use the Service.

2. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not share paid subscription access, dashboard access, authenticated downloads, MCP access, or other account-gated resources with unauthorized users.

Free accounts may access the design skill library and UI prompt catalog, subject to authentication and product limits. Copying, downloading, MCP access, design-system creation, and other account-gated creative features require an active TypeUI Creative or All-access subscription or active TypeUI Creative Lifetime access unless otherwise stated on the pricing page, campaign offer, or checkout terms. Analytics and session journeys require an active TypeUI Insights or All-access subscription.

We may suspend or terminate access if we reasonably believe your account is being used to violate these Terms, bypass access controls, redistribute TypeUI resources, abuse the Service, evade subscription checks, or infringe the rights of others.

3. Subscriptions, Billing, and Cancellation

TypeUI offers a Free account and paid monthly or yearly Creative, Insights, and All-access subscriptions. Creative provides the paid design and MCP features described on the pricing page. Insights provides analytics at the selected pageview allowance, currently offered at 100,000, 250,000, 500,000, 1 million, 5 million, 10 million, or 20 million pageviews per rolling 30-day period. Each tier also includes customer-defined custom events equal to 10% of that pageview allowance. Custom events above the included amount count one-for-one against the same workspace allowance. All-access includes both Creative and the selected Insights allowance in one bundled subscription. Current features and limits are shown on the pricing page and at checkout.

A valid, single-use AppSumo code may be redeemed once for the TypeUI Creative Lifetime described in the applicable campaign offer. The plan is linked permanently to the TypeUI account that redeems the code, cannot be transferred or stacked, and does not include TypeUI Insights. "Lifetime" means the commercial lifetime of the TypeUI Creative service, not the lifetime of any person or company. It has no recurring TypeUI subscription fee and includes up to 500 TypeUI MCP requests per calendar month, measured in UTC. Unused requests do not roll over. When the monthly allowance is reached, additional MCP requests are unavailable until the first day of the next UTC calendar month. Other Creative features remain available, subject to these Terms and the EULA.

An account may have only one current TypeUI subscription per billing provider at a time. Changing between Creative, Insights, and All-access, an Insights allowance, or a monthly and yearly billing interval changes that subscription; it does not create an additional concurrent subscription. Moving to All-access replaces the separate plan because All-access already includes Creative and Insights.

A plan change may take effect immediately or at the next renewal, as shown before confirmation. For an immediate change, the billing provider may apply a prorated billing adjustment for unused time and the remaining value of the new plan, then charge any amount due. For a scheduled change, the current plan and limits continue until the displayed change date. The provider-hosted confirmation or invoice, when available, shows the final charge, credit applied against provider billing, currency, and tax. A billing credit is not a cash refund and has no cash value. Only one scheduled plan change may be active at a time; a later confirmed change may replace the earlier schedule.

New subscriptions use the billing provider identified by the hosted checkout, currently Stripe or Polar. TypeUI may use an approximate country signal derived from the network request to select the provider intended for that market. The hosted provider independently verifies checkout availability, billing location, taxes, and legal eligibility. Existing subscriptions remain manageable through their original provider regardless of the current network location. TypeUI may prevent you from purchasing the exact same plan through both providers at once. If you have current Insights or All-access subscriptions through both Stripe and Polar, one current allowance from each provider is added to your rolling workspace quota. Within each provider, only the highest current tier counts, so an upgrade or downgrade replaces that provider's previous allowance instead of stacking it. Multiple subscriptions do not create duplicate billing credits or refunds. The selected price, billing interval, currency, renewal terms, taxes, and checkout details are shown before confirmation. Prices may change for future purchases or renewals, subject to any notice required by applicable law.

AppSumo redemptions are recorded separately from Stripe and Polar subscriptions. Redeeming a code does not cancel, replace, refund, or otherwise modify an existing subscription. If the same account also has a separately active Creative or All-access subscription or qualifying workspace access, the MCP policy for that separately active access applies while it remains active.

Paid subscriptions automatically renew until canceled. You can cancel through your TypeUI dashboard and the linked Stripe or Polar customer portal. Cancellation prevents future renewal charges, but does not retroactively refund prior payments. Unless your access is terminated for violation of these Terms, paid access remains active until the end of the paid billing period, after which your account may continue with Free access.

4. Refunds

All purchases, renewals, plan changes, and subscription fees are final and non-refundable, except only to the extent a non-waivable refund or withdrawal right is required by applicable law.

Canceling a subscription or scheduled plan change stops the applicable future change or renewal, but does not refund or credit the current or any previous billing period. A provider's prorated adjustment when switching plans is part of calculating the price of that plan change and does not create a general refund right. If applicable law gives you a mandatory remedy that cannot be waived, this section does not limit that remedy.

AppSumo purchases and refund requests are also subject to the terms and refund process presented by AppSumo. We may deactivate the corresponding TypeUI Creative Lifetime access after a refund, chargeback, code invalidation, fraudulent redemption, or material violation of these Terms. A deactivated or already redeemed code cannot be used to activate another TypeUI account.

5. License and Acceptable Use

Your use of TypeUI resources is governed by the EULA. In general, you may use TypeUI-generated output and permitted resources for personal, commercial, and client projects, but you may not redistribute, resell, lease, sublicense, publicly share, or make TypeUI resources available as standalone files, datasets, competing registries, templates, products, or services.

6. Generated Output and Review Responsibility

TypeUI provides design skill markdown files, UI prompts, resources, and UI direction for AI-assisted workflows. You are solely responsible for reviewing, testing, validating, and securing any output, code, design, accessibility behavior, or production implementation before use.

7. Intellectual Property

The Service, website, brand, source materials, design skill files, prompt catalog, copy, account-gated resources, Pro resources, and original content are owned by Bergside LLC or its licensors, except for open-source components or third-party materials that are expressly provided under separate license terms.

Subject to these Terms and the EULA, you retain ownership of your own projects and of derivative products you build using permitted TypeUI resources. We do not claim ownership of your final applications or websites merely because you used TypeUI.

8. Third-Party Services

The Service depends on or may integrate with third-party services, including infrastructure, authentication, billing, communications, analytics, support, integration, and AI-tool providers. Those services may experience outages, security incidents, delays, errors, or changes outside our control. To the maximum extent permitted by law, we are not responsible for a third party's service, availability, security, output, acts, omissions, terms, or privacy practices. Relevant providers and processing roles are described in our Privacy Policy and DPA.

9. TypeUI Insights Customer Responsibilities

If you install TypeUI Insights, you represent that you control the registered website and have a lawful basis for the processing you configure. You are responsible for required privacy notices, consent-management settings, honoring withdrawal and data-subject requests, and deciding which pages receive the tracker. Routes are discovered automatically on consented pageviews. You may not use Insights on pages intended to collect special-category or similarly sensitive information, and you must mark excluded content with the supported exclusion controls.

If you connect a payment-provider integration, you represent that you control or are authorized to act for the connected organization. You must create a dedicated token with only the permissions TypeUI identifies as required: orders:read for Polar, read access to Checkout Sessions and Invoices for Stripe, ortransaction.read for Paddle. You must leave write permissions disabled, choose a reasonable expiry, and promptly rotate or revoke the token if you suspect compromise. You are responsible for permissions you grant beyond those requested by TypeUI and for keeping copies of the token outside TypeUI secure.

TypeUI uses connected Polar, Stripe, and Paddle credentials only for server-side, read-only purchase synchronization and stores them with authenticated encryption in Supabase Vault. No online secret-storage system is risk-free. To the maximum extent permitted by law, Bergside is not responsible for access, changes, losses, or third-party actions caused by excessive permissions chosen by Customer, Customer's failure to protect, rotate, expire, or revoke a credential, or the payment provider's systems and acts. The disclaimers and liability limits below apply to connected integrations. Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded or limited.

Insights includes unlimited websites and tracked pages. The pageview allowance and its included custom-event allowance are shared across the workspace over each rolling 30-day period. If current subscriptions exist through both Stripe and Polar, the effective pageview allowance is the sum of one current allowance from each provider. The included custom-event allowance is 10% of the pageview allowance: for example, the 100,000-pageview tier includes 10,000 customer-defined custom events, and the 250,000-pageview tier includes 25,000. Quota usage equals pageviews plus custom events above the included custom-event allowance. Each excess custom event counts as one additional unit against the pageview allowance; custom events within the included amount do not reduce it. Sessions and automatically collected clicks, scroll-depth measurements, and other interaction signals do not independently consume the allowance.

Sessions, page journeys, and connected custom events are retained for a rolling 90 days, while aggregate analytics remains available during an active Insights subscription. If Insights access ends, collection pauses and remaining data is held for a 30-day recovery period before automatic deletion unless your order states otherwise. The entry tier includes 100,000 pageviews. Creative does not include Insights analytics. Collection pauses when pageviews plus excess custom events reach the applicable allowance. A batch that would cross the allowance is rejected in full, and automatic overage billing is not enabled.

A visitor is shown as live when the relevant pseudonymous session has recorded activity during the previous 90 seconds. Live, bot, location, device, engagement, and other analytics are estimates and may be delayed, incomplete, or affected by network conditions, browser behavior, filtering, and consent settings.

10. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by law.

TypeUI Insights is an analytics product, not an archival, disaster-recovery, or backup service. You are responsible for maintaining independent copies or exports of information you are legally, operationally, or commercially required to preserve. We do not warrant that analytics will always be available, complete, accurate, recoverable, or free from delay, corruption, deletion, or loss.

To the maximum extent permitted by law, Bergside LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, substitute services, or the cost of reconstructing data arising from or related to your use of the Service.

To the maximum extent permitted by law, Bergside is not responsible for the loss, corruption, delay, unavailability, unauthorized access, or deletion of customer or visitor data. Your sole and exclusive monetary remedy for a direct claim arising from service unavailability, a security incident, or data loss is a refund of no more than the fees you actually paid for the affected TypeUI paid service during its most recent billing cycle. Bergside's total aggregate liability for all claims arising from or relating to the Service will not exceed that same amount. This cap does not create a discretionary refund, credit, or general right to repayment. These limitations do not exclude or limit liability, compensation rights, withdrawal rights, or other remedies that applicable law does not permit us to exclude or limit.

11. Changes to Terms

We may update these Terms from time to time by posting the revised version on this page. Your continued use of the Service after changes become effective means you accept the updated Terms.
