End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you as the licensee and Bergside LLC as the licensor regarding your use of TypeUI design skill markdown files, UI prompts, workspace design systems, downloadable resources, paid resources, documentation, and associated content (collectively, the "Licensed Materials").
1. Grant of License
Subject to this Agreement and the Terms of Service, Bergside grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Licensed Materials for permitted purposes.
Free account resources may be accessed and used while you have a TypeUI account in good standing. Account-gated resources, including copying, downloading, MCP access, design-system creation, and paid-plan resources, may be accessed and used only while your TypeUI Creative or All-access subscription or TypeUI Creative Lifetime is active and in good standing, unless separate open-source license terms are provided with a specific resource.
2. Permitted Uses
You may use the Licensed Materials to:
- Generate, adapt, and apply design specifications, UI prompts, UI components, and design instructions for your own projects.
- Build unlimited personal, commercial, internal, and client projects.
- Build and release open-source projects using permitted output created with the Licensed Materials.
- Sell, distribute, and monetize applications, websites, and other end products created with the help of the Licensed Materials.
- Continue using derivative output and finished end products created while your TypeUI account or paid subscription was active.
If your paid subscription is canceled, expires, lapses, or is otherwise no longer active, you keep rights to derivative output and finished end products created during the active paid-access period, but you must stop accessing, downloading, updating, or using account-gated or paid-plan resources. Your account may continue to use Free resources subject to the access rules shown in the product.
TypeUI Creative Lifetime redeemed through AppSumo remains active for the commercial lifetime of the TypeUI Creative service unless it is deactivated after a refund, chargeback, invalid or fraudulent redemption, or breach of this Agreement or the Terms. Its MCP access is limited to 1,000 requests per UTC calendar month, with no rollover.
3. Prohibited Uses
You may not:
- Redistribute, resell, lease, rent, sublicense, publish, or share TypeUI resources as standalone files or collections.
- Use TypeUI resources to create a competing design skill registry, prompt marketplace, template library, dataset, or substantially similar product or service.
- Share your account, paid subscription access, dashboard access, authenticated downloads, MCP access, downloaded TypeUI files, or account-gated resources with unauthorized users.
- Remove proprietary notices, access controls, or attribution included with the Licensed Materials.
- Use the Licensed Materials in a way that violates applicable law, third-party rights, or the Terms of Service.
4. Ownership and Generated Output
The Licensed Materials are licensed, not sold. Bergside and its licensors retain all right, title, and interest in the Licensed Materials, including intellectual property rights in the original TypeUI resources.
Subject to this Agreement, you retain ownership of your own projects and final end products created with the help of TypeUI. Bergside does not claim ownership of your final applications, websites, or generated project code merely because you used TypeUI.
5. Account Access, Paid Term, and Termination
This Agreement applies when you access or use the Licensed Materials. If you subscribe to Creative or All-access and later cancel, your paid access remains active through the end of the billing period unless terminated earlier for breach, and your account may continue with Free access.
TypeUI Creative Lifetime is non-transferable and belongs only to the TypeUI account that redeemed its single-use AppSumo code. It cannot be shared, resold, reassigned, or stacked with another code. Deleting that TypeUI account permanently ends access associated with the redeemed code.
Your license rights may terminate automatically if you violate this Agreement or the Terms of Service. Upon termination, you must stop accessing and using TypeUI resources, but termination does not affect your right to continue using permitted derivative output and finished end products created before termination.
6. Refunds
All TypeUI purchases, renewals, plan changes, and subscription fees are final and non-refundable, except only to the extent a non-waivable refund or withdrawal right is required by applicable law. Renewal timing and cancellation options are shown in the hosted checkout and billing portal provided by Stripe or Polar. Canceling a subscription stops future renewal charges, but it does not refund or credit the current or any previous billing period. A prorated billing adjustment used to price a plan change is not a general refund right. AppSumo purchases and refund requests are handled under the terms and process presented by AppSumo; a refunded or charged-back purchase no longer grants a TypeUI license.
7. Disclaimers and Limitation of Liability
The Licensed Materials are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. You are responsible for reviewing, testing, validating, and securing all generated output before use in production.
To the maximum extent permitted by law, Bergside will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or substitute services. Your sole and exclusive monetary remedy for a direct claim under this Agreement is a refund of no more than the fees you actually paid for the affected TypeUI paid service during its most recent billing cycle, and Bergside's total aggregate liability will not exceed that same amount. This cap does not create a discretionary refund, credit, or general right to repayment. It does not limit liability or mandatory remedies that applicable law does not permit us to limit.
